It is an inevitable fact that, from time to time, disciplinary incidents will occur in the workplace. These may result from a number of factors.
Managers have a right to discipline employees for inappropriate behaviour or conduct.
Organisations must, however, have well-designed disciplinary rules and procedures which at least comply with the statutory minimum.
If employers fail to comply with the minimum statutory procedures, any resultant dismissal will be automatically unfair.
A failure on the part of the employer to fully use the appropriate procedure may result in successful claims for compensation being adjusted upwards by as much as 50%.
